RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT BETWEEN THE OCEAN CITY ZONING BOARD OF ADJUSTMENTS & MANOS LAW FIRM, LLC FOR LEGAL COUNSEL SERVICES FOR THE CALENDAR YEAR 2026

RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT BETWEEN THE OCEAN CITY ZONING BOARD OF ADJUSTMENTS & MANOS LAW FIRM, LLC FOR LEGAL COUNSEL SERVICES FOR THE CALENDAR YEAR 2026

 

WHEREAS, the Ocean City Zoning Board of Adjustments requires certain legal counsel services; and


WHEREAS, the Ocean City Zoning Board of Adjustments is desirous of entering into a professional services contract with Manos Law Firm, LLC, 2408 New Road, Suite 2, Northfield, NJ 08225 for professional legal services for the calendar year 2026; and

 

WHEREAS, it is determined in the best interest of the Ocean City Zoning Board of Adjustments to have said services performed; and

 

WHEREAS, Manos Law Firm, LLC has been determined to have the necessary expertise and ability to perform said work; and

 

WHEREAS, Manos Law Firm, LLC has agreed to serve as the Ocean City Zoning Board of Adjustment’s Solicitor for the calendar year 2026; and

 

WHEREAS, a contract for Professional Services with Manos Law Firm, LLC may be entered into without competitive bidding pursuant to N.J.S.A. 40A:11-5(1)(a)(i); and

 

WHEREAS, the City of Ocean City may enter into a non-advertised contract pursuant to the provisions of N.J.S.A. 19:44A-20.5; and

 

WHEREAS, Manos Law Firm, LLC has completed and submitted a Business Entity Disclosure Certification which certifies that Manos Law Firm, LLC has not made any reportable contributions to a political or candidate committee for an elected office in the City of Ocean City, New Jersey in the previous one (1) year period, and that the contract will prohibit Mark H. Stein, Esquire from making any reportable contributions through the term of the contract; and

 

WHEREAS, the Ocean City Zoning Board of Adjustment has reviewed the terms and conditions of the contract and recommend award of a professional service contract to Manos Law Firm, LLC for Professional Legal Services for the calendar year 2026; and

 

WHEREAS, this contract was not awarded through a fair and open process, pursuant to N.J.S.A. 19:44A-20.4 et seq.; and

 

NOW THEREFORE, BE IT RESOLVED by the Ocean City Zoning Board of Adjustment of the City of Ocean City, New Jersey that it does hereby award a Professional Services contract to Manos Law Firm, LLC, 2408 New Road, Suite 2, Northfield, NJ 08225 as the Solicitor for the Ocean City Zoning Board of Adjustment in accordance with the requirements of the Municipal Land Use Law and the New Jersey Division of Local Government Services as follows:

 

1.       The City of Ocean City shall collect escrow fees form the Zoning Board applicants which shall be applied to the cost of services according to the hours performed by the Ocean City Zoning Board of Adjustment’s Solicitor, Manos Law Firm, LLC as stated in provisions of the Municipal Land Use Law and the following fee schedule:

 

                  a.               Principal Attorney……………………………………………….. $    200.00 per hour

 

            2.   The Term of this Contract shall be for a period of One (1) Calendar Year beginning on January 1, 2026 and continuing through until December 31, 2026.

 

            3.   A copy of this Resolution and Contract shall be available for inspection in the City Clerk's Office of the City of Ocean City, NJ, City Hall, 861 Asbury Avenue, Ocean City, NJ and the Planning Office, 115 12th Street, Ocean City, NJ and shall be printed on one (1) occasion in the Sentinel Ledger.

 

            4.   A copy of the Business Entity Certification and the Sworn Statement By Professional Services Provider shall be on file with this resolution in the City Clerk’s Office of the City of Ocean City and the Planning Office.

 

 

Professional Service Contract – Manos Law Firm (Continued)

 

            5.   A copy of Manos Law Firm, LLC’s Business Registration Certificate (BRC) has been submitted and shall be placed on file in the City of Ocean City’s Planning Office.

 

BE IT FURTHER RESOLVED that the Ocean City Zoning Board of Adjustment is hereby authorized to enter into a formal contract agreement with Manos Law Firm, LLC beginning on January 1, 2026 and continuing through December 31, 2026 for professional legal services and to act as the Ocean City Zoning Board of Adjustment’s Solicitor, as listed and in accordance with the submitted proposal, this resolution and contract.

 

The Director of Financial Management certifies that non–escrow funds are contingent upon adoption of the 2026 Local Municipal Budget and shall be charged to the Operating Account No. 6-01-20-019-211 as Purchase Orders are issued and that escrow funds are available and contingent upon the applicants deposit of reasonable and sufficient escrow monies, chargeable to Trust Account No. T-12-56-175-027.
